Purpose/Objective:

The VP, Consumer Lending & Payments Compliance Officer is primarily responsible for executing the Compliance Monitoring Plan for the Consumer Lending & Payments business line. Identifies and manages the development and implementation of respective compliance regulation and fair lending efforts for Residential Mortgage, Home Equity and Consumer Lending Operations. Responsible for the analysis and assessment regulatory compliance by conducting periodic examination of lending exceptions, underwriter decisions, and overall performance of originated loans. Assists FVP QC & LOB Compliance Officer in the development monitoring program and review of new and existing products and services.

Participates in the development of policies and procedures for mortgage origination department. Participates in the implementation of all real estate lending policies, products, and strategies. Responsible for reviewing policies and procedures to ensure that originations, processing, closing, post-closing processes are completed in accordance with state and regulatory laws and applicable recommending changes if necessary. This includes policy and procedure review and development, identifying and implementing branch and staff training, HMDA, management, and reporting.

Key Accountabilities:

  • Ensures implementation and performs self-monitoring testing, identifying issues and preparing detail analysis of the results outlining the scope, sample size, audit findings and recommendations for corrective action based to address findings for the Retail Compliance. Provides guidance and training to the Bank Operation team in executing strategic objectives and identifying and resolving issues in collaboration and provides training as necessary. Completion of Continuity Compliance Reporting. 20%
  • Assists in the HMDA Specialist in monitoring, reporting and scrub of monthly HMDA data. Performing monthly testing of LAR data, identifying errors, providing feedback to HMDA Specialist as well as training for Line of Business Staff. 20%
  • Stays well-informed of regulatory and legal developments governing bank operations, products and services communicating these changes to the Line of Business. Collaborates with Line of Business in the development of an implementation plans for regularly changes and any necessary enhancements or resolutions ss in establishing policies and procedures. Regulations necessary to reduce risk and uphold ethical standards related to and required by one's duties. Resource for Line of Business compliance relating to Origination, Processing, Underwriting Closing processes. Including but not limited to Fair Lending, HMDA, Flood Insurance, etc. Serves as a member of various mortgage department committees that provide input into development and maintenance of departmental policies and procedures that pertain compliance. 20%
  • Oversees and manages investigations within Residential Mortgage, Home Equity and Consumer business lines, confirming complaint tracking within Archer, enabling analytics and insights that drive continual improvement throughout the organization ensuring assignment to Line of Business team member including documenting receipt, research, timely response, resolutions, and training is necessary. 20%
  • Completes Archer Control testing as required, monitors Line of Business completion of internal Risk Assessments, Control Monitoring and Vendor Management assignments. 10%
  • Prepares for and assists in facilitating Compliance Examinations, and Audits. Assists line of business with responding to compliance-related audit findings, creation of action plan to address findings, and tracking completion of the action plans in a timely manner. 10%
  • Other duties as they may be assigned.
  • Ensures compliance with all banking laws, rules, regulations, and prescribed policies/practices/procedures necessary to reduce risk and uphold ethical standards related to and required by one's duties.


Education:

  • Bachelor's degree or equivalent experience preferred
  • Continual educational programs in the industry


Experience:

  • 5+ years of experience in consumer, residential lending & loan servicing environment
  • 5+ years of banking and compliance experience
  • 1+ year of supervisory/leadership experience


Skills & Knowledge:

  • Knowledge of federal laws and regulations governing residential mortgage, closed-end home equity, home equity line of credit (HELOC) and consumer including but not limited to:, Unfair, Deceptive, or Abusive Acts or Practices, Privacy of Consumer Financial Information, E-SIGN Act and Electronic Signatures and Disclosures, Right to Financial Privacy Act, GLBA Privacy Rules, , Regulation Z, Regulation X, CARES Act, ECOA (Reg. B), TILA (Reg Z), RESPA (HUD's Reg X), HMDA (Reg C), Homeowner's Protection Act and Flood Disaster Protection, TCPA, FDCPA
  • Basic knowledge of all Privacy, Right to Financial Privacy, UDAPP, CAN-SPAM, National Do No Call, etc.
