Complaint Analyst (AGPA 302293) Job at Board of Barbering and Cosmetology
The California State Board of Barbering and Cosmetology is responsible for licensing cosmetologists, barbers, manicurists, estheticians and electrologists, as well as the establishments where the services are performed. The mission of the Board is to ensure the health and safety of California consumers by promoting ethical standards and by enforcing the laws of the barbering and beauty industry.
Job Description and Duties
The Associate Governmental Program Analyst (AGPA) independently reviews complaints and conducts administrative investigations against Board of Barbering and Cosmetology licensees. Incumbents work independently in executing a thorough administrative investigation of alleged violations and pursues cases for discipline where applicable. Duties include, but are not limited to, the following:
- Independently review incoming complaints relating to consumer harm, unlicensed activity, and health and safety to determine the most appropriate action to address alleged violations.
- Independently review and evaluate incoming inspection and/or Department of Investigation reports and photographs along with any supplemental report information obtained to determine appropriate disciplinary action.
- Respond in writing and/or by telephone to the most complex complaints regarding nail salons, barbers, cosmetologists, and estheticians from consumers, licensees, and other enforcement entities. Interpret and explain business and professions codes and Barbering and Cosmetology regulations to consumers, licensees, and other enforcement or governmental agencies.
- Perform internal administrative functions such as monitoring caseload using monthly enforcement reports and case aging reports to ensure efficiency and compliance with the Consumer Protection Enforcement Initiative recommendations.
- Independently identify, gather, assemble, evaluate, and preserve complainant, witness, licensee, and expert statements, and other evidence used in administrative discipline. Independently review all evidence obtained during investigation for sufficient facts that support a violation of the law. Prepare concise, detailed reports of the events of an investigation, which includes documenting evidence and statements from witnesses, and a general synopsis to ensure the findings are fully supported by facts and other evidence. Recommend appropriate action to the Enforcement Manger.
- Organize licensing and inspection history documentation for transmittal of cases to the Attorney General’s Office. Consult with the Deputy Attorney General during case preparation, settlement negotiations, hearings, and testify at hearings. Review all legal documents prepared by Deputy Attorney General before service for accuracy.
- Provide discipline recommendations to Enforcement Manager and Deputy Attorney General and negotiate settlements for disciplinary cases. Evaluate proposed decisions prepared by the Administrative Law Judge for accuracy.
