Special Note
This is a full-time, overtime exempt position on the Olympia Campus of The Evergreen State College. This position is an “at-will” appointment, exempt from Washington State Civil Service rules and the Fair Labor Standards Act overtime requirements.

Position Purpose
Under direction of the Associate Vice President for Human Resources, the Equal Opportunity Officer position exists primarily to support The Evergreen State College’s commitment to equal opportunity within the College’s educational and workplace settings. The incumbent is responsible for the College’s non-discrimination policy and programs, including facilitating informal resolution of complaints or reports of discrimination, harassment, and retaliation at the lowest possible level and in a cooperative rather than adversarial spirit; investigating complaints as warranted under the institution’s Non-discrimination and Title IX Policies and preparing investigation reports with findings and recommendations; interpreting relevant state and federal laws and providing College policy guidance on issues of non-discrimination; maintaining a civil rights incident database regarding the experience of the institution in matters related to complaints and investigations; make recommendations for resolution and remedies to prevent recurrence; and develop and deliver related training. The incumbent is also responsible for the development, implementation, and maintenance of the College’s affirmative action plan.

Nature and Scope

Essential Functions
Equal Opportunity
  • Ensure the College’s compliance with state and federal equal opportunity laws.
  • Develop relevant policies as appropriate and propose changes to applicable existing policies as needed.
  • Serve as the institutional respondent and liaison between the College and external state and federal enforcement agencies; work cooperatively with agencies in investigations that involve the College; and prepare information and responses for external complaints.
  • Investigate reports of employee Non-Discrimination and Title IX Policy violations; document findings and make recommendations for resolution.
  • Investigate complaints of retaliation from individuals who file and/or are otherwise involved in non-discrimination related investigations; document findings and make recommendations for resolution.
  • Ensure the non-discrimination module in the College’s Employee Policy Training is regularly updated to accurately reflect College policy and state and federal law.
  • Work collaboratively with other divisions of the College to facilitate non-discrimination trainings and presentations.
  • Maintain a database of complaints, incident reports, informal resolutions, investigations, and findings; analyze and report on the data as needed.
  • Assign cases and provide assistance as needed to temporary civil rights investigators.
  • Ensure College’s compliance with required pre-employment sexual misconduct information requests; respond to internal and external requests for sexual misconduct information regarding current and former employees.


Affirmative Action
  • Plan, organize, and oversee all aspects of the College’s affirmative action plan.
  • Measure effectiveness of the overall affirmative action program and ensure the College is in compliance with requirements.
  • Review, report on, and update the College’s annual affirmative action plan in accordance with College policy and state and federal law.
  • Consult with and provide direction and recommendations to divisional Vice Presidents, management staff, and employees to carry out intent of College policies and all actions required to meet the College’s affirmative action commitments.
  • Collaborate with College leadership on equal employment opportunity and affirmative action issues; advise on the modification and development of College policies and procedures to ensure the enhancement of equal employment opportunity for all employees and potential employees and compliance with state and federal affirmative action and equal employment opportunity laws and guidelines.
  • Ensure that the Invitation to Self-Identify forms for protected veterans and individuals with disabilities are utilized appropriately and thoroughly communicated.
  • Regularly review effectiveness of equal employment opportunity programs to ensure alignment with the College’s affirmative action plan goals and objectives.
  • Ensure all required posters are displayed.
  • Ensure that the affirmative action plan and equal employment opportunity policies are being followed and are thoroughly communicated.
  • Serve as liaison between the College and government agencies enforcing affirmative action requirements.

Additional Duties
  • Collaborate with the Title IX Coordinator to address complaints and ensure compliance with Title IX across the institution.
  • Serve as point of contact in absence of Title IX Coordinator on Title IX related matters, including responding to complaints of gender-based discrimination, sexual harassment, or sexual misconduct; monitoring initial intake of complaints and investigative processes; and coordinating resources, remedies, and interim measures as warranted for involved parties.
  • Other duties as assigned.

Knowledge Skills and Abilities
  • Advanced knowledge of state and federal non-discrimination, equal opportunity, and affirmative action laws, regulations, guidelines, and procedures governing the workplace and educational programming at institutions of higher education.
  • Advanced skill in conducting non-discrimination/unlawful harassment investigations, including knowledge of advanced investigative and formal report writing techniques.
  • Advanced knowledge, skill, and ability serving as an employer respondent and liaison with external equal opportunity enforcement agencies.
  • Exemplary written and interpersonal communication skills, including the ability to write complex reports, policies, administrative procedures, and responses.
  • Advanced knowledge of and commitment to best practices for promoting diversity, equity, and inclusion within the College community, including the ability to work effectively with students, faculty, staff, and external constituents from diverse and historically marginalized backgrounds.
  • Advanced skill and competency in conflict management and negotiation skills.
  • Ability to maintain professional and legal privacy and confidentiality as appropriate.
  • Advanced knowledge and competency in affirmative action plan and program development, implementation, and maintenance, including ability to collect, analyze, synthesize, and present qualitative and quantitative data.
  • Ability to maintain confidentiality of information and records.
  • Ability to carry out assigned job functions in a consistent and objective manner.
  • Ability to manage, prioritize, and perform multiple investigations requiring detail and accuracy.
  • Ability to plan complex work initiatives and facilitate work without direct supervision.
  • Ability to function independently and collaboratively at all levels of the institution, as well as with external entities.
  • Skill and ability in program evaluation and quality improvement tasks.
  • Ability to present complex concepts to a wide audience with differing backgrounds and educational levels and ability to communicate one-on-one with individuals in high stress situations.
  • Skill in and ability to use standard office equipment and computer programs, such as Microsoft Office (Word, Excel, Outlook, and PowerPoint), run reports, and perform internet research.

Minimum Qualifications
  • Bachelor degree.
  • Three years of professional experience conducting workplace misconduct or compliance-related investigations, including interpreting policies and/or regulations, preparing written reports, documenting findings, and proposing recommendations to prevent recurrence.

Desired Qualifications
  • Advanced degree in human resources, law, public administration, social sciences, or related area.
  • Human Resources or related professional certification.
  • Three years of professional experience with workplace non-discrimination, sexual harassment, or Title IX related investigations in a higher education setting.
  • Progressively responsible experience with affirmative action plan development, implementation, and reporting.
  • Professional experience in conflict resolution, negotiations, and mediation.

Conditions of Employment
  • Must provide proof of identity and employment eligibility within three days of beginning work.
  • Prior to a new hire, a background check including criminal record history will be conducted. Information from the background check will not necessarily preclude employment but will be considered in determining the applicant’s suitability and competence to perform in the position.
  • Prior to an official offer of employment, a Declaration Regarding Sexual Misconduct form must be submitted to the college per RCW 28B.112.080. The college will contact current and past employers to verify this information. Applicants who provide inaccurate information in their declaration will be disqualified and, if the inaccuracies are discovered after the applicant has been hired, it shall be grounds for termination.
