OVERVIEW:


The Contract Manager will hierarchically report to the Head of Contract Management in Spain, and functionally to the Program Management Director in the US. This position will cooperate on a daily basis with the Program Managers within the program portfolio and will manage the execution of main client contracts (from rolling stock supply to rail services realization). This position will advise the Program Managers on the best contractual strategy with an eye toward reducing costs and risks and increasing profits and also be responsible for supporting the preparation, negotiation and review of main client contracts liaising with pre-contract teams as well as supplier or subcontracts as requested by procurement department.

FUNCTIONAL DESCRIPTION:

  • Ensure the drafting of timely and precise contractual correspondence, variation orders are properly identified and managed and contract close-out, extension or renewal.
  • Ensure all project contributors are suitably aware of contract terms
  • Manage all contractual communication with the customer to make certain that everything is correctly registered
  • Manage contractual records and documentation, including contractual correspondence and change orders, with the Program Manager
  • Manage any contractual claims, coordinating with the Legal department including reviewing and negotiating settlement agreements.
  • Provide contractual interpretation on different provisions to protect the company’s interests and mitigate risks, including making recommendations and supporting negotiation with customers
  • Provide support on the correspondence with interested third parties (e.g. the regulator (NoBo/DeBo, Network authority, etc.) as required.
  • Provide support and guidance to all stakeholders through complex negotiations in both escalated technical and non-technical requirements.
  • Complete post-contract analysis, monitor competitive terms, identify lessons learnt and propose improvements on terms and conditions.
  • Develop and implement procedures for contract management and administration in compliance with company policy. As appropriate, contribute to or influence company policies.
- Ensure accurate records are completed and maintained in accordance with procedures in place, and work in progress is communicated to Line Managers. - Ensure that all work carried out is compliant with health, safety and environmental
legislation and Company policies and procedures.

  • In addition to the duties and responsibilities outlined, you may be required to undertake other duties commensurate with your level and competence, which may result from changing circumstances, but which may not of necessity, change the general character or level of responsibility to the post.

TRAINING/EDUCATION REQUIRED:

  • BA/BS Degree from an accredited university in Engineering or Law, Business Administration or other suitable subject.
  • Minimum of 5 years of experience in the management of preferential contracts in the railway sector.
  • Experience in complex industrial projects and public contracts (B2G)


QUALIFICATIONS/REQUIREMENTS:

  • Knowledge of how to write contracts/letters and their related Terms and Conditions
  • Good computer skills, including familiarity with text input
  • Ability to communicate effectively
  • English language fluent and good understanding of Spanish
  • Knowledge of schedule management software a plus
