Sandy Springs, Community Bank is seeking an experienced Director of Loan Operations. We are seeking a candidate with solid and diverse Commercial/SBA lender experience. This position serves as the Loan Compliance Officer, responsible for ensuring the Company is in compliance with all state and federal regulations as it relates to loan documentation, policy, procedure and regulation. This position is responsible for supervising staff in loan operations and managing a variety of loan operational duties on commercial and consumer loans by using comprehensive knowledge of policies, procedures and regulatory compliance requirements.

Responsible for acting as audit liaison between external auditors and bank management and Board of Directors of the following areas: Internal Controls audit, BSA, ACH and loan and deposit regulation compliance. In relation to this, reviews and appraises the soundness, adequacy, effectiveness, and proper knowledge base of third parties as it relates to auditing of the bank. Reviews audit findings and reports detailing exceptions and recommendations for improvement, and responsible for maintaining the audit tracking worksheet.

Identifies and coordinates ongoing training attendance and coursework for the organization.

ESSENTIAL FUNCTIONS AND BASIC DUTIES

1. Oversees Loan Operations and Manages the Loan Operations Staff

  • a. Reviews commercial and consumer loan documents and is charged with upholding documentation to company standards and ensuring all loan documentation is complete, accurate and legally enforceable.
  • b. Ensures that any special conditions, terms or requirements imposed under loan approval have been complied with.
  • c. Reviews and understands credit presentations to ensure loan document request conforms with parties to the loan, terms, collateral and conditions as outlined therein.
  • d. Responsible for the overall coordination of contract documentation and UCC filing processes.
  • e. Performs review of Loan Officers documentation for new loan and loan modification packages.
  • f. Examines records, procedures, performances, and controls for fraud, errors, or deficiencies. Maintains control and confidentiality of all documents.
  • g. Examines credit and financial documents to determine compliance with established policies, standards, and legal requirements, as necessary.
  • h. Identifies, resolves and reports discrepancies, errors, and other detected problems.
  • i. Utilizes knowledge and experience in exercising discretion and judgment to meet deadlines and resolve problems.

2. Acts as the Loan Compliance Officer

  • a. Manages, implements, and ensures compliance with applicable lending laws and regulations. Communicates directly with bank personnel regarding suggested loan documentation and compliance improvements as it relates to transaction structure or changes required due to state or federal regulations.
  • b. Reviews and implements regulatory changes. Compiles reference resources for the Company’s daily use to ensure compliance with regulations. Provides assistance and support to Lenders and Loan operations personnel. Provides guidance and direction to all areas concerning loan documentation requirements and policies.
  • c. Responsible for developing policies and procedures for loan compliance and operational issues. Conducts periodic reviews of existing policies to ensure accuracy, efficiency, and effectiveness.
  • d. Ensures policies and procedures are updated and are in accordance with evolving regulations, legal requirements, and industry trends.
  • e. Coordinates and develops ongoing compliance training.

3. Assumes responsibility for acting as Liaison between bank management/Board of Directors and third party vendors for Internal Control examinations, BSA, ACH, Loan and Deposit Compliance

  • a. Oversight of internal audit reviews on these areas and reports and tracking of audit findings and recommendations.
  • b. Participates in the development of new or improved procedures and programs as it relates to Loan Operations and loan compliance.
  • c. Assists in establishing or revising internal process and operational controls to ensure the adequate protection of Company assets.

4. Assumes responsibility for ensuring that professional business relationships are established and maintained with external business contacts and professionals.

  • a. Maintains the Company’s reputation, both internally and externally. Maintains appropriate levels of confidentiality.
  • b. Resolves requests, complaints, or problems promptly.
  • c. Represents the Company in contacts with business and trade associations and otherwise promotes the Company’s interests.

5. Assumes responsibility for related duties as required or assigned.

  • a. Manages and coordinates special projects as instructed by management
  • b. Primary contact with special investigations, regulatory or loan compliance audits. c. Stays informed of trends and developments in state and federal requirements, regulatory compliance and loan processes.
  • d. Accountable for compliance with all laws, regulations and adherence to established internal controls and procedures when performing job duties.

Will be committed to maintaining a high level of compliance with all Lending laws, regulations and compliance requirements as well as the Bank Secrecy Act and Anti Money Laundering, USA PATRIOT Act and Financial Record keeping regulations and must participate in required training on pertinent compliance laws and regulations as required by Bank.

PERFORMANCE MEASUREMENTS

1. Loan operational functions are accurately and effectively performed in accordance with Company policies, procedures, and legal requirements. Discrepancies, errors, and problems with documentation are promptly identified and resolved.
2. Upholds integrity, accuracy and quality of loan documents. Continuously monitors workflow and processes to minimize negative impact on client/borrower or the company.
3. Loan operations staff is properly trained, supervised and performing at the optimal level.
4. Required reports are accurate, timely, and informative.

QUALIFICATIONSEDUCATION/CERTIFICATION: Bachelor’s degree in Business Administration or related field.

REQUIRED KNOWLEDGE

Thorough understanding of lending and bank operational functions.
Three or more years loan review of commercial loan operations and documentation.
Internal audit experience within deposit and accounting areas of a bank.

EXPERIENCE REQUIRED:

Five to ten years of progressive commercial loan compliance and documentation experience. Specifically commercial/SBA lender experience.
Experience in financial services position, bank operations or auditing.
Proficient in loan policy, regulatory compliance and loan operations.
Familiarity with auditing procedures and functions of non-loan related areas.

Strong prioritization and organizational skills
Able to operate all related computer software applications.
Community Banking Experience is a plus.
